Abstract

Rape is a breach of women's dignity & respect for oneself, and when occurs in a home’s
four-walls and restricts a woman to the level of a subject used exclusively to fulfill sexual needs.
Rape is a phenomenon in marriage that makes the woman die and disrespect from her heart. The
fear of facing it and of still having to suffer silently is an insupportable thought which has an
effect on women’s psyche. The social, psychological & mental health of women is influenced
very damagingly by this self-enforced silence. If violence happens within the domestic sphere, it
is at its worst form- an entity that is ostensibly the harmless precinct of human life. The effect of
domestic ferocity remains utmost damaging the spouse who is theoretically be the female’s
guardian is also acting as culprit of such abuse. However, in spite of the conclusiveness of
agreement to matrimonial cohabitation, the spouses commit sexual harassment. Culture and
government do not not consider this sexual abuse by married people, which greatly impairs the
place of women in community and often maintains the status quo of the subjugated position of
women within the family in culture. This paper discusses about the concept of marital rape and
what it is all about in order to provide understanding to the user about the importance of law for
this crime and its implications
